Question: Tax Return Intercept question...?

Is there a site or anything like that to check and see if the IRS will be intercepting your taxes for any reason?

We just got a letter in the mail for this company that stated that they will be intercepting his tax return due to an upaid public defender YEARS ago from prior to us being married. So I know that I can't file an injured spouse claim (as this qualifies me because it is a seperate obligation) in time for the rebate check, but am not sure how the IRS does this???? Since it just came about and there's 30 days to pay in full before this will happen, how do I or would I find out when the IRS looks this up and if it will interfere? I just find it a bit unfair that I cannot file an injured spouse form and have my share saved that way and they'd still be able to intercept it all??

The real kicker is up until this letter came we never even knew the bill was out there????

Answer: THERE'S A NUMBER YOU CAN CALL TO SEE IF YOUR TAXES WILL BE OFFSET.
FMS (FINANCIAL MANAGEMENT SERVICES)IS A BRANCH OF THE TREASURY DEPARTMENT THAT ISSUES FEDERAL REFUNDS.CALL THEM AT 1-800-304-3107 AND ENTER YOURS OR HUSBANDS SOCIAL AND IT WILL SAY IF U HAVE A DEBT OR NOT,IF YOU DO THEY WILL SAY WHO IS REQUESING YOUR REFUND TO BE OFFSET AND THE PHONE #.
IF IT HAS BEEN OFFSET ALREADY THEY WILL SAY WHEN AND FOR HOW MUCH .IT'S AN AUTOMATED MACHINE SO YOU CAN CALL ANYTIME ,AND AS OFTEN YOU WILL LIKE.

REGARDING INJURED SPOUSE CLAIM,YES YOU CAN FILE IT IF YOU FILED A JOINT RETURN AND YOU ARE NOT RESPONSIBLE FOR THE DEBT.FORM 8379 AND SEND IT TO THE PLACE YOU SENT YOUR TAX REFUNDBY MAIL ALSO NOT ELECTRONICALLY.
YOU HAVE UP TO 6 MONTHS TO FILE IT TOO B/C THE IRS WILL NOT RELEASE A OFFSET REFUND WHEN IT IS FILED JOINTLY WITH A SPOUSE TIL AFTER 6 MONTHS TO GIVE A SPOUSE TIME TO FILE A CLAIM.CALL IRS AND THEY WILL TELL YOU WHAT TO DO FROM HERE.GOOD LUCK!
