Question: what year income tax form do we file to get the first time home buyers tax credit?
We just put in an offer on a home and it has been accepted. Now we wait for closing before we can move in. If we don't close until January 2010 do we have to wait until we file our 2010 tax return or can we claim the credit on our 2009 tax forms?
Answer: Your choice. Most folks will claim it on their 2009 return (either the original return or an amended return) in order to get the money faster. There's nothing to stop anyone from waiting a year and claiming it on their 2010 return though I doubt that many will choose that option for obvious reasons.
